General Information About KVKK

Canbolat Vip Transfer Turizm - Ali İhsan CANBOLAT (hereinafter referred to as "www.canbolattransfer.com") processes personal data obtained within the framework of the principle of respect for private life, in accordance with the Personal Data Protection Law No. 6698 ('KVK Law') (hereinafter referred to as KVKK). The KVKK grants personal data owners the right to obtain information about their personal data, access this data, learn the purpose for which this data is used, and request the correction or deletion of this data.

Pursuant to the first paragraph of Article 13 of the KVK Law; www.canbolattransfer.com, as the data controller, must submit applications regarding these rights in writing using this Personal Data Owner Application Form or other methods determined by the Personal Data Protection Board (“Board”).

In this context, written applications to www.canbolattransfer.com can be submitted by printing this form and:

  • Via notary public,

  • By personal application of the applicant,

  • By sending it signed with a "secure electronic signature" as defined in the Electronic Signature Law No. 5070 by the applicant to our company's registered electronic mail address,

  • By sending it to the registered e-mail address info@canbolattransfer.com which was previously notified to www.canbolattransfer.com. Explanations regarding written application channels and information notes to be specified in submissions are provided in the table below.

About Application Subjects

Any individual whose personal data is processed, as per Article 11 of the KVKK, can apply to www.canbolattransfer.com in the manner mentioned above and request information regarding the subjects listed below:

  • To learn whether personal data is processed.

  • To request information if personal data has been processed.

  • To learn the purpose of processing personal data and whether personal data is used in accordance with its purpose.

  • To learn the third parties to whom personal data is transferred, domestically or abroad.

  • To request correction of personal data if it is incomplete or incorrectly processed, and to request notification of the transaction made within this scope to third parties to whom personal data has been transferred.

  • To request the deletion, destruction, or anonymization of personal data if the reasons for processing them cease to exist, and to request notification of the transaction made within this scope to third parties to whom personal data has been transferred.

  • To object to the emergence of a result against the data owner solely through the analysis of processed data by automated systems.

  • To demand compensation for damages if personal data is processed unlawfully.

Subjects Excluded from the Application Right

Pursuant to Article 20 of the KVKK, in the cases listed below, since they are outside the scope of KVKK, personal data owners cannot exercise their application rights:

  • Processing of personal data for purposes such as research, planning, and statistics by anonymizing it with official statistics.

  • Processing of personal data for artistic, historical, literary, or scientific purposes, or within the scope of freedom of expression, provided that it does not violate national defense, national security, public safety, public order, economic security, privacy of private life, or personal rights, or constitute a crime.

  • Processing of personal data within the scope of preventive, protective, and intelligence activities carried out by public institutions and organizations authorized by law to ensure national defense, national security, public safety, public order, or economic security.

  • Processing of personal data by judicial authorities or enforcement authorities regarding investigation, prosecution, trial, or execution procedures.

Pursuant to Article 28, paragraph 2 of the KVKK, it is not possible to exercise the rights, except for the right to demand compensation for damages, in the following situations:

  • If the personal data processing is necessary to prevent the commission of a crime or for a criminal investigation.

  • Processing of personal data made public by the data subject themselves.

  • If personal data processing is necessary for the performance of supervision and/or regulatory duties or for disciplinary investigation or prosecution by public institutions and organizations with duties and authorities granted by law, and professional organizations with the quality of public institutions.

  • If personal data processing is necessary for the protection of the economic and financial interests of the State regarding budget, tax, and financial matters.

Canbolat Transfer's Procedure and Period for Responding to Applications

In accordance with Article 13 of the KVK Law, www.canbolattransfer.com will conclude personal data owners' application requests free of charge within 30 (thirty) days at the latest, depending on the nature of the request. However, if the process requires an additional cost, the fee specified in the tariff determined by the KVK Board may be charged. Our company may accept the application or reject it by explaining its reasons for the reasons listed below and notify the relevant person in writing or electronically. The application of the personal data owner may be rejected in the following cases:

  • Preventing the rights and freedoms of others.

  • Requiring disproportionate effort.

  • The information being public information.

  • Jeopardizing the privacy of others.

  • The existence of one of the cases excluded under the KVKK (see 2.2.).

Right of the Personal Data Owner to Lodge a Complaint with the Board

Pursuant to Article 14 of the KVK Law, in cases where the personal data owner's application is rejected, the given answer is deemed insufficient, or the application is not answered within the period, the personal data owner may lodge a complaint with the KVK Board within thirty days from the date they learn of the data controller's answer and in any case within sixty days from the date of application. A complaint to the Board will not be possible without an application to our company.

Other Possible Issues

www.canbolattransfer.com may request additional information from the relevant data owner and ask questions related to the personal data owner's application to clarify the matters contained in the application.
